Gender and the Law

This class seeks to understand how law and society shape each other around the interrelated issues of sex, gender, gender identity and sexuality as we seek insight into the broader question of how society and its conflicts make demands on the law for solutions. We will evaluate the philosophical challenges of those solutions, and see how the law evolves over time and across different societies with different pressing needs and agendas. We will learn skills in two areas of legal writing: applying legal rules to answer legal questions and creating policy arguments based on normative evaluations of legal precedents. Finally, we will think about what shifts in the law reveal about our concept of ourselves as subjects and citizens before the law and law’s role in justifying our relationship with our system of government. The specific topic of this Law and Society course will be how gender and sexuality constitute us as citizens before the law, and with what rights and obligations gender and sexuality endows us. Assessments will include quizzes, a midterm, and a final.
